Default Tevez waits on High Court's Friday Deadline

The Blades' lawyers have been in touch with Joorabchian this week and they privately believe the club have a strong chance of winning a favourable verdict on Friday.


A source close to Joorabchian said: 'If the judge rules all the paperwork must be made public we will be forced to co-operate.


'We have no idea how significant the paperwork may be - all we know is we have done nothing wrong.'


It is understood the documentation could potentially be harmful to West Ham's case and in the long run that may go some way to helping settle the contractual wrangle which is holding up Tevez's transfer to Manchester United.


But Joorabchian would prefer for the matter to be settled out of court.


Joorabchian and Tevez wrote to West Ham on Tuesday and the Premier League asking for the player's registration and contract to be cancelled - but their approach was turned down.


Joorabchian is also considering an appeal for FIFA to step in as arbiters to try to untangle the contractual mess.


FIFA say they may be prepared to step in to settle the transfer dispute - but they have yet to receive any official request to do so.


Football's world governing body can become involved if there is an international element to a transfer or if they are asked to by the FA.


Tevez's move to United has stalled due to the Premier League's insistence that West Ham must receive the bulk of the reported £30million fee.


Tevez's representative, businessman Joorabchian, claims he owns the player's economic rights.


A FIFA spokesman said: 'We have not received any official request from any of the parties involved so far.


'If we do receive a request we would then decide whether we have to look at it or if it is up to the FA to rule on it.


'The FA could also ask us for guidance and send us all the relevant information.'

Manchester United's pursuit of Carlos Tevez edged closer to the courts last night after the Premier League rejected an attempt by MSI, the offshore company that brought the player to the Premiership, to cancel his registration with West Ham United. The Premier League also rejected a personal letter from Tevez in which he notified them that he was terminating his contract with the London club.
The Premier League refused to allow both Tevez's letter and MSI's request on the grounds that it does not consider that MSI have any rights over the player's registration, having been informed by West Ham that the club has torn up its agreements with MSI. Last Thursday the league ruled that Tevez could not join Manchester United unless West Ham received any transfer fee in full.

The moves by MSI to free up the player to join United came as it emerged that the Old Trafford hierarchy has ruled out paying West Ham anything for the player as they do not consider that the London club are his owners.
United's position, established after talks with MSI, who own Tevez's commercial rights, directly contradicts the Premier League's view. United are satisfied however that West Ham have no rights over Tevez and Old Trafford has been in negotiations with MSI's front man, Kia Joorabchian, over a two-year loan deal that would include a right to buy the player for a pre-arranged fee during that period. United also think that Tevez's registration will transfer to them as they believe that technically the Argentinian forward is a free-agent.

United's stance threatens to undermine the agreement reached between the Premier League and West Ham in April after the club was found guilty of breaking rules governing third-party agreements. On the morning after West Ham were fined £5m for breaching regulation U18 the Premier League board informed West Ham that Tevez could continue playing for them if the offending contract, between West Ham and MSI, was unilaterally terminated by the club.

West Ham are bound by undertakings given in a letter to the Premier League following the ruling in which they said the contract with MSI had been terminated. The league also made it clear that it has power of veto over any transfer, and that it would only accept a commercially realistic transfer fee for the player. The league will also not wave through any deal in which Joorabchian was the primary beneficiary. Were they to allow any such deal, or for the transfer to take place without West Ham's approval, it would make a mockery of the assertion that the third-party agreement with MSI was terminated.

In order for the Premier League's ruling to hold water West Ham have to demonstrate that they own the player, exercising their rights by acting as the selling club. Last night a West Ham source insisted that it had received no offer from Manchester United, and until it did Tevez would remain their player.

This leaves legal action in either the civil courts or the Court of Arbitration for sport as the the most likely resolution to the deadlock, and the escape route that would allow all parties to retire satisfied.

If, say, the CAS were to assert MSI's rights to receive a fee for Tevez the Premier League would have little choice but to allow the deal to proceed, but would be seen to have defended the integrity of its regulations. West Ham, who had not expected a transfer feel before the league's intervention, would also be happy with such an outcome.

This is just going to be a gigantic mess that is just going to drag on and on and on and on. I really wish we would just end the negotiations on this as we don't even need Tevez, and he's not worth all the headaches this is causing and will continue to cause.

I mainly blame the FA for screwing this whole thing up so badly. Typical of them though.

I was thinking that this thread should be in the transfers section... but since it's the worst kept secret in football, with him coming to United, I'll keep it in here.

This whole deal is getting stranger by the minute. I'm really getting uncomfortable with it. I know innocent, until proven guilty, but damn...

I really wish United would pull out of this. I know United has great lawyers and know how to deal with transfers. But the 3rd party, the EPL screwing the pooch with West Ham/Sheffield, and just the numerous amounts of bad pr.

Oh, did I mention that Carlitos isn't the forward that United needs?

The purported transfer of Carlos Tevez to Manchester United has taken a fresh twist, with the news that an arrest order has been issued for businessman Kia Joorabchian, the representative responsible for the player's affairs.

A federal judge in Brazil has charged Joorabchian, amongst others, with money-laundering and being part of a criminal gang, for the role he played in the relationship between Media Sports Investment (MSI), the company he fronts, and Corinthians, the Brazilian club he first took Tevez to, before bringing him to England.

"The (MSI) transactions are carried out with the use of numerous offshore accounts which have the single and well-known intention of distancing the investor and the illicit origin of the resources from their final destination, in this case the purchase and sale of (football) players," the federal attorneys Silvio Luis Martins de Oliveira and Rodrigo de Grandis are quoted as saying on Brazilian legal website consultor Juridico.

The detention of Corinthians president Alberto Dualib has also been ordered, along with that of Russian oligarch Boris Berezovsky, whose money is thought to have bankrolled MSI. Both face similar charges.

News of Joorabchian's impending arrest has overshadowed the news, revealed exclusively to Sky Sports News on Thursday, that Tevez would wrap up his move to Manchester United in the next few days.

Suspicions of corruption were raised by the failure of money involved in the purchasing of players to be passed through the country, in a chain of events which has manifest accusations of money laundering. Both MSI and Corinthians have reportedly been unable to clarify the origins of the money, which proceeded to lead to the investigation, that has ultimately led to Joorabchian's impending arrest and cast further doubts over Tevez's move to United.

Joorabchian has been at the centre of the furore caused by Tevez's switch to West Ham, which concluded at the campaign's end with the Premier League club being fined £5.5million, having been found guilty of third-party ownership.

Sheffield United, who feel they should be reinstated to the top flight, at West Ham's expense, have taken the matter to the High Court, but it would appear Joorabchian now has more pressing affairs of his own.

as far as Joorabchian, I wish i had my old posts from the old forum where I found a way to link Joorbachian to Berezovsky and Ambramovich. Uggg that's really the only thing i miss.

I don't know but as it stands right now, we might get him this wednesday at the earliest. I am not even sure how much of an impact he will have on our team.

Was waiting for this. I expected it earlier on to be honest. Wednesday can't come soon enough. We'll all get the clarity on the situation and hopefully either two things are done:

1. The transfer goes through without a hitch and we don't have to hear/read about this anymore.

2. The transfer is not permitted and United have to move on without Tevez.

Curbishley also hit out at Yossi Benayoun after the Israeli left Upton Park for Liverpool earlier this week.

The Hammers chief believes Benayoun was happy to stay at the club until he heard of Liverpool's interest.

"I was disappointed with Yossi because he had signed a new contract and it turns out he hadn't," added Curbishley.

"When Liverpool came in for him it changed everything.

"I didn't want Yossi to go and we didn't need the business."

um, Mr. Gill. Tell us something we don't know. The ramificaitons for Manchester United if this deal goes sour are enormous. Surely, there had to be another player *Adriano* who United could have gone after. I'm just praying that everything works out fine.

'There has been some momentum regarding the player's next move in terms of through his agent, but nothing clear at this moment in time.'

The team arrived in Tokyo on Monday without the injured quartet of Park Ji-sung, Gary Neville, Louis Saha and Ole Gunnar Solskjaer, who all had surgery earlier this year.

Ferguson expects Neville to rejoin the squad after their two-week Asian tour, Solskjaer soon after that and Saha in early to mid-August.

Park is not expected to be fit until the second half of the season, but will join the squad for their match against FC Seoul in the South Korean capital on Friday.

The four-match tour concludes against Chinese sides Shenzhen FC on July 23 and Guangzhou Pharmaceutical FC on July 27.

West Ham would appear to be planning for life without Tevez by bringing in Craig Bellamy, but they remain adamant that he is contracted to them for another three years.

Tevez submitted a written request to West Ham last week asking to be released from his contract but they refused.

what's funny about this is that with Fifa now involved it is caught in the middle. It can go with the strict legal approach and rule against West Ham, and thus showing the FA were a bunch of lunatics, or they go against United, and Joobcharian sues everyone since he just lost $X.

What is it with Tevez and these weird transfers. Even in brazil he had all this baggage.

thats for the same reason he is having trouble now.. lol

MSI paid to have him and Mascherano leave Argentina and go to Corinthians...

basically its all cuz Joobs is involved
